+ Community Service Leave and Redundancy Pay

The new 'Rudd' system replaces the Australian Fair Pay and Conditions Standard introduced by WorkChoices by a new safety net called the National Employment Standard (NES). It is understood that these changes will commence operation from 1 January 2010.
The NES will add to a non-award employee's current entitlements, interalia, community service leave and for the first time, redundancy pay.
The community service leave will include an entitlement to leave from work in respect of jury service and voluntary emergency management activities – e.g. where the employee is a volunteer member of the NSW Bushfire Service.
Where employers have more than 15 employees, the redundancy pay is expected to be on a sliding scale from 4 weeks' pay where there is less than 2 years service to 12 weeks' pay where there has been more than 10 years' service.
Redundancy pay will be calculated on the employee's base rate of pay.
